📘 KWENTOON TERMS OF USE AND COMMUNITY GUIDELINES

These Terms govern access to and use of Kwentoon’s websites, applications, content, products, services, and community features. These guidelines are intended to protect the Kwentoon community, safeguard the platform, respect the rights and work of creators, and maintain a respectful, trustworthy, secure platform.
By creating an account, submitting an application, purchasing or accessing content, or otherwise using Kwentoon, the user confirms acceptance of these Terms
1. Eligibility, Parental Consent, and Account Security
To create an account, a user must be at least 18 years old to independently create and manage a Kwentoon account. A minor may use Kwentoon only with the consent and supervision of a parent or legal guardian, who must review these Terms and the Privacy Notice, supervise the account, approve purchases when applicable, and ensure that the information provided is accurate.
Users must provide accurate information, keep their accounts and login credentials secure, and promptly report suspected unauthorized access. Accounts and login credentials may not be sold, transferred, lent, or shared with unauthorized persons.
Kwentoon may require certain information to process and verify an account, including but not limited to identity, age, parental consent, creator, publisher, or organization/ affiliation. If the required information or consent cannot be verified, the account may have limited access, be suspended or closed.
2. Disclosure of Affiliations
Such affiliation does not automatically affect eligibility. The information allows Kwentoon to assess applications responsibly, identify potential conflicts of interest, protect the interests of the community, and consider appropriate opportunities for collaboration or partnership.
Applicants must provide complete and accurate information when such disclosure is requested.
3. Intellectual Property
The Kwentoon name, logo, branding, platform design, software, systems, features, documentation, marketing materials, and company-owned content are owned by or licensed to Kwentoon.
Creators, publishers, licensors, and other applicable rights holders retain ownership of the original content they submit, publish, or authorize for use through Kwentoon, unless otherwise provided in a separate written agreement.
Purchasing or accessing content does not grant permission to reproduce, upload, distribute, modify, sell, or use the material outside Kwentoon without written approval from Kwentoon or the applicable rights holder.
Users may not copy, scan, record, reproduce, redistribute, commercially use, remove ownership notices from, or misuse Kwentoon’s platform, systems, data, branding, or content. Paid content, files, screenshots, access links, referral codes, and account details may not be shared with unauthorized persons.
Kwentoon content and creator materials may not be used for another platform, commercial service, promotional material, merchandise, dataset, or artificial-intelligence training without prior written permission.
Access to Kwentoon does not transfer any ownership or intellectual-property rights.
4. Responsible and Child-Safe Platform Use
Kwentoon provides age-appropriate access for children, teens, and other users. Access to content and platform features may vary depending on the user’s age and account category. Parents or legal guardians are asked to guide minors, particularly children, when creating and using their accounts.
Users must not upload, share, promote, comment, or link to content that:
- exploits, sexualizes, grooms, endangers, or targets a child;
- contains sexually explicit, pornographic, sexualized, or otherwise age-inappropriate material;
- promotes or advocates sexual conduct or age-inappropriate sexual or romantic themes to minors;
- promotes abuse, exploitation, trafficking, self-harm, or unlawful activity;
- contains excessive graphic violence or gore;
- promotes bullying, harassment, discrimination, hate, or hostility toward any person;
- contains partisan political campaigning, electioneering, political propaganda, or ideological advocacy;
- is fraudulent, deceptive, misleading, or impersonates another person;
- contains scams, phishing links, malicious software, or other harmful material; or
- is otherwise inconsistent with applicable law, Kwentoon’s child-friendly values, or its community guidelines.
Interactions involving minors or their work must remain respectful, age-appropriate, relevant, and free from harassment, exploitation, solicitation, or requests for unnecessary personal information.
5. Platform and Security Restrictions
Users must not use automated tools to collect content or information, bypass platform controls, access unauthorized accounts or areas, manipulate transactions or engagement, interfere with Kwentoon’s systems, test vulnerabilities without written permission, or collect or use non-public information without authorization.
6. Confidential Information and Independent Activities
Kwentoon may provide selected users with non-public information, including unpublished works, private previews, project plans, creator information, pricing, internal processes, technical materials, or upcoming platform features.
Information identified or reasonably understood as non-public must be kept confidential, used only for its intended purpose, and not copied, disclosed, distributed, commercially used, or shared without written permission from Kwentoon or the applicable rights holder.
Kwentoon respects independent creative and business activities. However, Kwentoon’s confidential information, protected content, and non-public user, creator, or business information may not be used for another product or service without written permission. Any separate agreement with Kwentoon remains applicable.
7. Payments, Purchases, and Platform Features
Payments may be processed through authorized providers, with prices and purchase terms presented at checkout. Users must provide accurate payment information and must not use unauthorized payment methods, falsify payment evidence, manipulate transactions, or improperly reverse valid payments.
Digital purchases provide limited, personal, and non-transferable access and do not transfer ownership rights. Refunds, failed transactions, cancellations, promotions, pre-orders, and campaigns are subject to applicable policies and additional terms. Unless otherwise stated, promotional benefits have no cash value and may not be transferred or sold.
Kwentoon may use third-party services for payments, authentication, hosting, analytics, communications, and other platform functions. These services may be governed by their own terms and privacy notices. Kwentoon is not responsible for independent websites, transactions, deliveries, promises, or services that it does not control or officially authorize.
8. Data Privacy
Kwentoon processes personal data in accordance with the Data Privacy Act of 2012, applicable regulations, and its Privacy Notice. Personal data may be collected, used, retained, and shared with authorized personnel or service providers as reasonably necessary for legitimate platform, transaction, security, compliance, analytics, and service-improvement purposes.
Kwentoon implements reasonable and appropriate safeguards. To the extent permitted by law, Kwentoon shall not be liable for unauthorized access, loss, or disclosure caused by circumstances beyond its reasonable control, without limiting any rights or responsibilities that cannot legally be excluded.
11. Account Review and Enforcement
Kwentoon may review, limit, suspend, terminate, or decline access when necessary to protect users, creators, minors, content, privacy, intellectual property, payments, confidential information, or platform security.
This may include cases involving false information, unverifiable consent, inappropriate conduct, piracy, scraping, fraud, security concerns, misuse of confidential information, or serious policy violations. Kwentoon may provide an opportunity for clarification when appropriate but may act immediately and without prior notice in urgent cases.
12. Changes and Governing Terms
By creating an account or continuing to use Kwentoon, the user confirms that all information provided is complete and accurate, accepts these Terms and any applicable updates, and agrees to respect Kwentoon’s community, users, creators, intellectual property, privacy, confidential information, content, and systems.
Kwentoon content and non-public information may not be copied, shared, scraped, commercially used, or used for another platform without written permission. A parent or guardian who approves a minor’s account accepts responsibility for its supervision and management.
These Terms are governed by the laws of the Republic of the Philippines. Disputes should first be raised with Kwentoon in good faith, without limiting available legal rights or remedies. If any provision is found invalid or unenforceable, the remaining provisions will continue to apply.
